A trademark is registered electronically in the Kingdom of Saudi Arabia through the Saudi Authority for Intellectual Property (SAIP). The registration process involves several key stages, beginning with filing the application and ending with the issuance of the trademark registration certificate.
1. Conducting a Trademark Search Search: Before filing an application, it is advisable to search for existing trademarks to ensure that no identical or similar trademark may prevent registration. This helps reduce the likelihood of the application being rejected.
2. Accessing the SAIP Platform: Visit the Saudi Authority for Intellectual Property platform, select Trademark Services, and access the service portal using National Single Sign-On or email.
3. Filing a Trademark Application: Select the service for registering a new trademark, specify whether the applicant is an individual, establishment, or company, complete the required information, and attach the necessary documents.
4. Paying the Application Examination Fee: After submitting the application, an invoice for the trademark examination fee will be issued. SAIP will begin reviewing the application once the fee has been paid.
5. Examination and Review of the Trademark: SAIP examines the application, and the outcome may be one of the following: acceptance of the trademark, conditional acceptance subject to amendments, or rejection of the application.
6. Paying the Publication Fee: If the trademark is accepted, an invoice for the publication fee will be issued. Once the fee has been paid, the trademark proceeds to the publication stage.
7. Publication of the Trademark: The trademark is published in the Intellectual Property Gazette for 60 days, during which third parties may file an opposition to its registration.
8. Paying the Final Registration Fee: If the publication period ends without any opposition, the final invoice will be issued and must be paid within 30 days from its date of issuance.
9. Issuance of the Trademark Registration Certificate: Once the final payment has been completed, the trademark registration certificate will be issued.
